The paid service “Signed Rental Value Colomer Expertises” consists of providing a commercial code rental value. Refined in consideration of the commercial lease, plans and market knowledge by Colomer Expertises. It includes changes in the rental values of the sector, which are not statistical. This rental value does not constitute an opinion of value with regard to the five criteria of Article L. 145-33 of the Commercial Code, the assessment of which requires a thorough examination of the contractual and technical documents as well as an on-site visit of the leased premises. The result delivered corresponds to a gross rental value that does not take into account any deductions or corrective mechanisms provided for by the Law. This paid service does not consist of studying the conditions of a possible revision or a possible uncapping. Thus, the conditions of Article L 145-38 of the Commercial Code are not examined, namely the material modification of local commerciality factors and the possible variation of more than 10% of the rental value due to said material modification.
This opinion does not have the same legal value as an expert opinion produced in court which is the subject of a detailed report. It is only in the interest of allowing the lessee to measure the opportunity to negotiate his rent, to revise his rent, or to dispute the renewal value proposed by his lessor.
Gouache Avocats takes your problem into consideration as part of an appointment, carries out an initial analysis of the contractual documents (commercial lease, amendments) and notices of expiry, communicates them to Colomer Expertises, helps you determine a strategy to obtain the downward fixing of your rent, and verifies on the basis of the Colomer Expertises opinion:
- if a request for a downward or upward revision of the rent is possible on the basis of Article L 145-39 of the Commercial Code, specifying the timing and modalities of implementation of such a request; the calculation of the evolution of the rent (25% compared to the last fixing) will be delivered,
- the timing and modalities of implementation of a request for a downward or upward revision of the rent on the basis of Article L 145-38 of the Commercial Code by explaining the textual conditions of such a request without deciding on its feasibility, said conditions having to be examined by an expert specialized in rental value estimation such as, for example, Colomer Expertises, unless the expert has previously provided the firm with this information;
- in the event that a downward or upward revision of the rent is not possible, the timing and modalities of implementing a renewal of the lease at a rent corresponding to the rental value by explaining the textual conditions of a renewal without deciding on the feasibility of a fixation at the rental value, said conditions (namely significant modification of the elements mentioned in 1° to 4° of Article L. 145-33 of the Commercial Code) must be examined by an expert specialized in rental value estimation such as, for example, Colomer Expertises, unless there is an exception to the capping rules following a clause of the contract relating to the duration of the lease.
If Colomer Expertises were mandated to write an expert report on the same premises, a price of €249 excluding taxes would be deducted from the fees invoiced for this report.

Note: Le Cabinet Colomer Expertises:
- cannot decide on the so-called Monovalent Premises, built for a single use, within the meaning of Article R 145-10 of the Commercial Code (for example: Theatre, Cinema, Hotel, Hospital),
- proposes that the said Premises visit the site and draw up a complete report, according to the methodology and practices observed in the industry in question.
