Review your rent at the right price

We can get your rent reduced during a commercial lease.

You can lower the rent on your commercial lease in two ways if you meet certain conditions.

These two legal modes should not be confused with indexation (or conventional revision) which may be provided for by an indexation clause (or sliding scale clause) in your lease.

Test immediately if you can reduce your rent!

We work closely with Colomer Expertises, a firm specialising in estimating rental values, which makes it possible to:

  • Test for free if your rent falls within a range of rental values calculated on your catchment area

Test your rent

  • if you find that you can save, for just €690 excl. tax, Gouache offers to:
  • tell

  • you when and how to get the rent review;
  • obtain a rental value signed by Colomer Expertise, to validate the financial advisability of the amicable or judicial action;
  • set up an amicable or  judicial action; the €690 excluding taxes received during the previous steps are deducted from any services invoiced by Gouache Avocats and Colomer Expertises on this occasion.

In the event of an amicable or judicial action, we will intervene as part of a basic package (allowing the firm to carry out the first steps) and a result related to the amount of sums recovered.

1st mode: the so-called triennial revision on the basis of Article L 145-38 of the Commercial Code

You may request that the rent be revised to the rental value lower than the current rent if you provide proof that since the last fixing the two conditions of Article L 145-38 of the Commercial Code are met, namely
– 1/ a material modification of the local factors of commerciality and
– 2/ a variation of more than 10% of the rental value due to said material modification.

You can object to the landlord revising the rent according to the evolution of the indices over the last three years if the rental value is between the current rent and the revised rent.

2nd mode: if your lease includes an indexation clause, the revision in case of rent variation of more than 25%

You may request (on the basis of Article L 145-39 of the Commercial Code) that the rent be revised to the rental value lower than the rent in force whenever, through the indexation clause, the rent is increased by more than one quarter compared to the price previously fixed contractually or by judicial decision.

The clause that would prohibit legal review below a minimum (e.g. below the initial rent) is unlawful.

In both cases, we may obtain a refund of the sums overpaid to the lessor since the date of your request for review.
