A trademark application offers its owner special and limited territorial protection

A trademark is protected either for the territory of a State (for example France), or for a set of States offering a unitary trademark right for the entire territory of its Member States (for example within the European Union for which a European filing_to be made in addition to the French filing_ is provided).

Whenever you want to develop your business internationally, you will need to register your brand in the country concerned. The filing /obtaining of protection must be prior to the conclusion of a distribution contract that would concede the use of the trademark, under penalty of risk of nullity of this contract.

You have to anticipate: registration times can be long. But not too much: brands expire through non-use. The risk of trademark revocation exists in the medium term if it is not seriously exploited. Broad international protection is also costly and must represent an investment linked to a current international development strategy.
